What Is the FDNY?
The Fire Department of the City of New York (FDNY) is the largest municipal fire department in the United States and one of the oldest, established in 1865. Beyond responding to fires and medical emergencies, FDNY's Bureau of Fire Prevention is responsible for enforcing the NYC Fire Code across all building types.
The Bureau of Fire Prevention employs hundreds of fire inspectors who conduct routine and complaint-based inspections of commercial, residential, and industrial properties. It also issues permits for activities involving fire hazards, manages the Certificate of Fitness program, and reviews fire safety and evacuation plans.
The NYC Fire Code — which FDNY enforces — covers fire alarm systems, sprinkler and standpipe systems, means of egress, fire safety plans, hazardous materials storage, commercial cooking equipment, and much more. FDNY has authority to issue violations, seal premises, and order immediate evacuations when life-threatening conditions are found.
FDNY's Jurisdiction & Authority
FDNY's Bureau of Fire Prevention has broad authority over fire safety in every NYC building. Key areas of jurisdiction include:

Limitations of FDNY
Understanding what FDNY does not handle helps property owners route issues correctly:
- FDNY does not issue construction permits — DOB handles all construction permitting, even for fire protection system installations.
- FDNY does not adjudicate its own violations — monetary penalties are handled through ECB/OATH hearings.
- FDNY does not enforce the Building Code — that's DOB's jurisdiction. FDNY enforces the separate NYC Fire Code.
- FDNY inspectors cannot perform fire protection system repairs — only licensed contractors can do corrective work.
- FDNY does not regulate environmental hazards like asbestos or lead paint — those fall under DEC and HPD respectively.
