FDNY Fire Safety Violations & Compliance

The Fire Department of New York enforces fire safety codes across all buildings. BVS resolves FDNY violations involving sprinkler systems, fire alarms, egress, and fire safety plans.

    What Is the FDNY?

The Fire Department of the City of New York (FDNY) is the largest municipal fire department in the United States and one of the oldest, established in 1865. Beyond responding to fires and medical emergencies, FDNY's Bureau of Fire Prevention is responsible for enforcing the NYC Fire Code across all building types.

FDNY's Bureau of Fire Prevention employs hundreds of fire inspectors who conduct routine and complaint-based inspections of commercial, residential, and industrial properties. The Bureau also issues permits for activities involving fire hazards, manages the Certificate of Fitness program, and reviews fire safety and evacuation plans.

The NYC Fire Code, which FDNY enforces, covers fire alarm systems, sprinkler and standpipe systems, means of egress, fire safety plans, hazardous materials storage, commercial cooking equipment, and much more. FDNY has the authority to issue violations, seal premises, and order immediate evacuations when life-threatening fire safety conditions are found.

    FDNY's Jurisdiction & Authority

FDNY has broad authority over fire safety in all buildings in NYC. Key areas of jurisdiction include:

Fire alarm and detection system installation, testing, and maintenance

    Sprinkler and standpipe system compliance

Means of egress — exit signs, emergency lighting, stairway clearance

Fire safety and evacuation plans for commercial and residential buildings

Certificates of Fitness for fire safety personnel

Permits for welding, torch operations, and flammable materials storage

Commercial cooking equipment (Type I hoods, ansul systems)

Gas shut-off valve requirements and gas safety inspections

    Limitations of FDNY

    • FDNY does not issue construction permits — DOB handles all construction permitting, even for fire protection system installations.
    • FDNY does not adjudicate its own violations — monetary penalties are handled through ECB/OATH hearings.
    • FDNY does not enforce the Building Code — that's DOB's jurisdiction. FDNY enforces the separate NYC Fire Code.
    • FDNY inspectors cannot perform fire protection system repairs — only licensed contractors can do corrective work.
    • FDNY does not regulate environmental hazards like asbestos or lead paint — those fall under DEC and HPD respectively.

    Types of FDNY Violations

    Sprinkler Deficiencies

Non-functional, impaired, or missing sprinkler systems in required occupancies.

    Fire Alarm Violations

Malfunctioning or non-code-compliant fire alarm systems, missing smoke or CO detectors.

    Blocked Egress

Obstructed exits, locked fire doors, missing exit signage, or inadequate emergency lighting.

    Missing Fire Safety Plans

Buildings required to have fire safety and evacuation plans that are outdated or absent.

    Standpipe Issues

Non-functional or improperly maintained standpipe systems in high-rise and commercial buildings.

    Certificate of Fitness

Required staff lacking valid FDNY Certificates of Fitness for fire safety operations.

    How FDNY Inspections Work

FDNY conducts routine inspections based on building type and occupancy classification. High-rise buildings, places of assembly, commercial kitchens, and buildings with hazardous materials are inspected more frequently. Inspections can also be triggered by complaints, fire incidents, or permit applications.

During an inspection, FDNY inspectors check fire protection systems (alarms, sprinklers, standpipes), means of egress (exit signs, emergency lighting, stairway clearance), fire safety plans, Certificate of Fitness compliance, and general housekeeping. Violations are issued on the spot and carry specific correction deadlines.

    How BVS Resolves FDNY Violations

    1

    Violation Review

We analyze the specific FDNY violation to understand what corrective action is required.

    2

    Contractor Coordination

We engage licensed fire protection contractors to repair, replace, or install required fire safety systems.

    3

    Documentation

We prepare and file all required certifications, test reports, and compliance letters.

    4

    Re-Inspection

We schedule FDNY re-inspections and ensure all conditions are met for violation dismissal.

    The Stakes of FDNY Non-Compliance

FDNY violations carry significant penalties and represent genuine life-safety risks. Non-compliance can result in vacate orders, building closures, and personal liability for building owners and managers.

    • ECB penalties ranging from $500 to $10,000+ per violation
    • Premises sealed or vacated for life-threatening conditions
    • Criminal liability for willful non-compliance resulting in injuries
    • Insurance complications and increased premiums
