    What Is the Department of City Planning?

    The NYC Department of City Planning (DCP) is responsible for the city's physical and socioeconomic planning, including the administration of the Zoning Resolution — a 4,000+ page regulatory document that governs virtually every aspect of land use and building form in New York City.

    Zoning determines what can be built where — the permitted use, maximum building size, required setbacks, parking, and open space. Every construction project must comply with zoning, and violations can halt projects indefinitely. DCP also leads the Uniform Land Use Review Procedure (ULURP) for major development projects and zoning changes.

    DCP works closely with the City Planning Commission (CPC), a 13-member body that votes on zoning changes, special permits, and other land use actions. Together, DCP and CPC shape the physical development of NYC's neighborhoods, balancing growth with community needs.

    DCP's Jurisdiction & Authority

    DCP's authority is centered on the Zoning Resolution and land use policy. Key areas include:

    Limitations of DCP

    • DCP does not issue violations or conduct inspections — DOB enforces zoning compliance in the field.
    • DCP does not grant variances — the Board of Standards and Appeals (BSA) is the body that grants zoning variances and certain special permits.
    • DCP does not issue building permits — that's exclusively DOB's function. DCP provides zoning certifications that DOB requires for permit issuance.
    • DCP cannot override community opposition to land use changes — all ULURP actions involve mandatory community board review and City Council approval.
    • DCP's zoning interpretations can be appealed to BSA, so DCP does not have final authority on disputed zoning questions.

    Types of Zoning Violations

    While DCP itself doesn't issue violations, zoning non-compliance triggers DOB violations and can block construction permits. Common zoning issues include:

    Use Violations

    Operating a business or occupancy type not permitted in the zoning district (e.g., commercial use in a residential zone). These are among the most serious zoning violations.

    Bulk Violations

    Exceeding permitted floor area ratio (FAR), building height, lot coverage, or rear yard requirements. Often discovered during plan review or neighbor complaints.

    Parking Violations

    Failing to provide the required number of parking spaces for the building's use. Common in conversions and change-of-use applications.

    Signage Violations

    Non-compliant commercial signage exceeding size, illumination, or placement limits set by the zoning district.
